Los Angeles Spousal Support Lawyers

Spousal support is a written agreement or court order that requires a spouse to make payments to support the other spouse. According to state law, a spousal support request should be filed with the court before any spousal payments are made so that there can be no disagreement or dispute that the money given from one spouse to another is in fact alimony. We can help you establish or modify spousal support. Contact Oddenino Law Group today.

How California Determines Spousal Support

Spousal support is decided on factors including, but not limited to:

  • The earning capacity of each party as it relates to maintaining a reasonable standard of living
  • The marketable skills of the supported party
  • The extent to which the supported party contributed to the attainment of an education, career, etc. by the supporting party
  • The ability of the supporting party to pay spousal support based on their earned and unearned income, assets, standard of living, etc.
  • The standard of living of each party
  • The duration of the marriage
  • The age and health of each party
  • Documented evidence of any history of domestic violence
  • Tax consequences to each party involved

California has a 10-year rule that states that marriages of 10 years or more are considered marriages of long duration. As such, the court is not allowed to set a definite termination date for spousal support at the time of the trial.
